1. General
1.1 Supplemental terms. These E-money Terms of Service ("E-money Terms of Service") apply to Hosts who have opted into and agreed to the Pro Photography and Pro Video Terms of Service. They should be read in conjunction with and supplement the Payments Terms of Service for European Users and the Pro Photography and Pro Video Terms of Service. If there is a conflict between these E-money Terms of Service and the Payments Terms of Service or the Pro Photography and Pro Video Terms of Service, these E-money Terms of Service will take precedence with respect to the issuance and redemption of e-money for you by Airbnb Payments UK Limited.
1.2 Modification. Except as otherwise required by applicable law, Airbnb Payments UK may modify these E-money Terms of Service in the same way as it may modify the Payments Terms of Service.
1.3 Interpreting these E-money Terms. Where the context admits, references in the Payment Terms of Service to "Payment Services" shall include the services provided by Airbnb Payments UK under these E-money Terms of Service, and to these "Payment Terms" shall include these E-money Terms of Service.
2. E-money Account
2.1 Photo or Video Shoot Cost. When you opt into and agree to the Pro Photography and Pro Video Terms of Service, you agree that Airbnb will make payment to the photographer on your behalf and that the cost of your photo or video shoot ("Photo or Video Shoot Cost") will be subtracted from your next payout, even if your next payout comes from a different listing in accordance with the Pro Photography and Pro Video Terms of Service. Such payment to the photographer will be made by Airbnb Payments UK on your behalf from your e-money account (your "Airbnb E-money Account"), in accordance with these E-money Terms of Service.
2.2 Funds flows. On receipt of confirmation that the photography or video service has been completed, the following will happen:
2.2.1 Airbnb Ireland will make a payment to Airbnb Payments UK on your behalf of the amount due to the photographer in respect of the Photo or Video Shoot Cost (the "Funding Payment");
2.2.2 when it receives the Funding Payment, Airbnb Payments UK will issue e-money to you in a sum equal to the value of the Funding Payment and will credit your Airbnb E-money Account balance accordingly;
2.2.3 immediately following this credit to your Airbnb E-money Account, Airbnb Payments UK will pay a corresponding amount to the photographer on your behalf for the Photo or Video Shoot Cost in accordance with the Pro Photography and Pro Video Terms of Service, so using your Airbnb E-money Account balance; and
2.2.4 in the event that Airbnb Payments UK is unable to make payment to the photographer or where such payment fails, the Photo or Video Shoot Cost will be returned or credited to your Airbnb E-money Account. Airbnb Payments UK will make further attempts to pay the photographer until such payment attempt is successful.
2.3 Payment Authorization. You authorize Airbnb Payments UK to make payment to the photographer for the Photo or Video Shoot Cost using your Airbnb E-money Account balance, as described above. You will not be able to withdraw your consent or cancel this payment once you have given your authorisation to Airbnb Payments UK to make the payment.
2.4 Execution time. Airbnb Payments UK will endeavour to ensure that photographers based in the UK will receive the payment for the Photo or Video Shoot Cost by the end of the business day following Airbnb Payments UK’s initiation of such payment.
3. Additional Terms
3.1 E-money Account features. Your Airbnb E-money Account will not be able to receive funds other than as described in these E-money Terms of Service.
3.2 Other terms and conditions. Although you are the 'e-money holder' of the sums in your Airbnb E-money Account, you acknowledge that you are also subject to the terms and conditions (for example, the Pro Photography and Pro Video Terms of Service) under which funds are provided to you by Airbnb Ireland or any other Airbnb company to fund your Airbnb E-money Account (such as the Funding Payment) and that you are required to pay back such funds in accordance with the relevant terms and conditions.
3.3 No interest. You will not receive interest on or any other benefit relating to the balance held in your Airbnb E-money Account. The balance on your Airbnb E-money Account is not a deposit and you do not have any right to seek compensation under the UK's Financial Services Compensation Scheme.
3.4 No fees. Airbnb will not charge you any fees for your use of your Airbnb E-money Account.
4. Security
4.1 Blocking funding payments. We reserve the right to refuse to accept any particular funding payment or to suspend or block your Airbnb E-money Account without notice in the interests of preventing fraud, money laundering or any other criminal activity.
5. Closure and termination of your Airbnb E-money Account
5.1 Automatic closure. Once payment to the photographer has been made, Airbnb Payments UK will automatically close your Airbnb E-money Account and these E-money Terms of Service will terminate on such closure.
5.2 Termination. Termination of these E-money Terms of Service will not affect any other agreements you have entered into with Airbnb, including the Payments Terms of Service which will continue in full force and effect.
6. Other provisions
6.1 No assignment. You may not assign, transfer, or delegate this agreement or your rights and obligations hereunder without Airbnb Payments UK’s prior written consent. Airbnb Payments UK may without restriction assign, transfer, or delegate this agreement and any rights and obligations, at its sole discretion, with two (2) months’ prior notice.
6.2 Governing law. These E-money Terms of Service will be interpreted in accordance with English law. As a consumer, you may bring any judicial proceedings relating to these Payments Terms before the competent court of your place of residence or a court in England. If Airbnb wishes to enforce any of its rights against you as a consumer, we may do so only in the courts of the jurisdiction in which you are a resident. If you are acting as a business, you agree to submit to the exclusive jurisdiction of the English courts.
